Free movement of workers in European Union

The theme of the research paper is: “Free movement of workers in European Union”. It is regulated in article 45 of Treaty of Functioning of the European Union, which states as follows:

1.Freedom of movement for workers shall be secured within the Union.

2.Such freedom of movement shall entail the abolition of any discrimination based on nationality between workers of the Member States as regards employment, remuneration and other conditions of work and employment.

3.It shall entail the right, subject to limitations justified on grounds of public policy, public security or public health:
(a)to accept offers of employment actually made.
(b)to move freely within the territory of Member States for this purpose;
(c)to stay in a Member State for the purpose of employment in accordance with the provisions governing the employment of nationals of that State laid down by law, regulation or administrative action;
(d)to remain in the territory of a Member State after having been employed in that State, subject to conditions which shall be embodied in regulations to be drawn up by the Commission.

4.The provisions of this Article shall not apply to employment in the public service.”

The structure of the paper should contain three parts:

1.Introduction
Brief description of the theme and main points that will be analyzed.

2.Body
Each paragraph of article 45 should be analyzed theoretically (based on academic references), and supported with a case laws from European Court of Justice. For instance, in paragraph one, if we are discussing the free movement of workers, we should explain the legal concept of “workers”, a detailed analyze of what “free movement of workers” means and what exactly it represents, such as: what rights do the workers have, etc.

Each following paragraph should be analyzed in the same way.

3. Conclusion
Representation of the main points discussed in the paper.

The research paper should contain 2500-3000 words, excluding references, bibliography and footnotes.

The research paper should be supported by academic references, which should be cited as footnotes in the body part of the paper and as bibliography in the end of the paper. The references should be APA style and there should be a minimum of 15 academic references.

Furthermore, each legal concept of each paragraph of article 45 of TFEU should be supported by case laws from European Court of Justice. The conclusion of the court in each case law should be used as an argument to support the legal concept which will be analyzed in each paragraph.

There must be at least 10 case laws in total.
